Welcome to Train Smart PR. These Terms and Conditions govern your use of our website, services, programs, purchases, and interactions with Train Smart PR. By accessing our website, booking a service, purchasing a program, or participating in any Train Smart PR activity, you agree to these Terms and Conditions.

1. About Train Smart PR

Train Smart PR provides structured fitness, recovery, performance, and wellness services, including but not limited to:

Pre-operative optimization programs, post-operative recovery programs, return-to-run programs, AlterG treadmill training, KAATSU/BFR training, strength and mobility training, sports injury recovery support, and related wellness services.

Train Smart PR is not an emergency medical provider. Our services are designed to support fitness, performance, recovery, and wellness goals but are not a substitute for emergency medical care.

2. Use of Website

By using our website, you agree to use it only for lawful purposes. You may not use the website in any way that could damage, disable, overburden, impair, or interfere with the website or its security.

You agree not to:

Use the website for fraudulent or unlawful purposes, attempt to gain unauthorized access to the website or related systems, copy or misuse website content without permission, submit false or misleading information, or interfere with the operation of the website.

3. Eligibility to Use Services

Train Smart PR services may be available to adults and, when appropriate, minors with parent or legal guardian consent.

By booking or purchasing services, you represent that the information you provide is accurate and that you are medically able to participate in the selected program or have obtained appropriate medical clearance when needed.

Train Smart PR reserves the right to refuse or discontinue services if participation may present a safety concern, if required information is incomplete or inaccurate, or if client behavior is inappropriate, unsafe, or disruptive.

4. Medical Disclaimer

Train Smart PR may provide fitness, recovery, wellness, and performance-related services. These services do not replace medical diagnosis, treatment, physical therapy, surgical care, or advice from your physician or licensed healthcare provider.

You should consult your physician before beginning any exercise, recovery, or wellness program, especially if you have a medical condition, recent surgery, injury, cardiovascular disease, uncontrolled blood pressure, blood clot history, pregnancy, neurological condition, or any other health concern.

Participation in Train Smart PR programs is voluntary and involves physical activity, which carries inherent risks, including but not limited to muscle soreness, fatigue, dizziness, falls, injury, aggravation of a prior condition, or other medical complications.

If you experience chest pain, shortness of breath, dizziness, fainting, severe pain, sudden weakness, or any concerning symptoms, stop activity immediately and seek medical care.

5. Client Responsibilities

Clients are responsible for providing accurate health, medical, injury, surgery, medication, and activity information before and during participation.

Clients agree to:

Disclose relevant medical history, follow staff instructions, use equipment only as directed, arrive on time for scheduled appointments, wear appropriate clothing and footwear, notify staff of pain or symptoms during sessions, and obtain medical clearance when requested.

Failure to provide accurate information may increase risk and may result in denial or discontinuation of services.

6. Appointments, Scheduling, and Attendance

Appointments are scheduled based on staff and equipment availability. Clients are expected to arrive on time.

Late arrivals may result in a shortened session without refund or credit. Train Smart PR may reschedule appointments due to staff availability, equipment maintenance, safety concerns, emergencies, or circumstances outside our control.

7. Cancellations and No-Shows

Clients must provide at least 24 hours’ notice to cancel or reschedule an appointment unless otherwise stated in a specific program agreement.

Appointments cancelled with less than 24 hours’ notice may be counted as a used session. No-shows may also be counted as a used session and are not refundable.

Repeated late cancellations, no-shows, or failure to follow scheduling policies may result in loss of scheduling privileges or forfeiture of remaining sessions.

8. Payments

Payment may be required before services are provided. Prices may vary by program, package, session type, promotion, or membership.

By purchasing a service, you agree to pay all applicable fees and charges. Train Smart PR may use third-party payment processors, including but not limited to Stripe or other secure payment platforms.

Payment information is processed by the third-party payment provider according to its own terms and privacy policy. Train Smart PR does not control third-party payment processing policies.

9. Refunds

Refunds, credits, cancellations, and unused session policies are governed by the Train Smart PR Refund Policy. By purchasing a service, program, package, or product, you agree to the terms of that Refund Policy.

Used sessions, missed appointments, late cancellations, no-shows, completed services, and expired packages are generally non-refundable.

10. Program Expiration

Program packages and session bundles must be used within the time period stated at purchase. If no specific expiration period is stated, sessions should generally be used within 90 days of purchase unless otherwise approved in writing by Train Smart PR.

Unused sessions after the expiration period may be forfeited and are not refundable.

11. Promotional Offers

Promotions, discounts, special offers, trial sessions, and bundled programs may have separate terms and may be limited by time, availability, eligibility, or program type.

Train Smart PR may modify, suspend, or discontinue promotional offers at any time. Promotional purchases may be non-refundable unless otherwise stated in writing.

12. Products and Equipment

Train Smart PR may sell or recommend products, equipment, devices, or accessories. Product availability, pricing, return eligibility, warranties, and manufacturer policies may vary.

Train Smart PR does not guarantee that any product will achieve a specific result. Clients are responsible for using products according to manufacturer instructions and safety guidance.

13. Results Disclaimer

Individual results vary. Train Smart PR does not guarantee specific outcomes, including but not limited to pain relief, weight loss, improved performance, surgical outcome, return to sport, bone density improvement, strength gain, or recovery timeline.

Results depend on many factors, including medical history, diagnosis, surgery type, consistency, nutrition, sleep, medication use, activity level, genetics, and adherence to recommendations.

Testimonials, examples, or progress stories are not guarantees of similar results.

14. Assumption of Risk

By participating in Train Smart PR services, you understand that physical activity and use of exercise or recovery equipment involve risks. You voluntarily assume the risks associated with participation.

These risks may include, but are not limited to, soreness, fatigue, strain, sprain, fall, fracture, cardiovascular event, worsening symptoms, or other injury.

You agree to follow instructions, communicate symptoms, and stop activity if you feel unsafe or unwell.

15. Limitation of Liability

To the fullest extent permitted by law, Train Smart PR, its owners, staff, contractors, affiliates, representatives, and related entities shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, services, programs, equipment, or products.

Nothing in these Terms is intended to limit liability where such limitation is not permitted by applicable law.

16. Website Content

All website content, including text, graphics, logos, images, videos, service descriptions, educational materials, and page design, is owned by or licensed to Train Smart PR unless otherwise stated.

Website content is provided for general informational purposes only. It should not be copied, reproduced, distributed, modified, or used commercially without written permission from Train Smart PR.

17. Intellectual Property

Train Smart PR names, branding, logos, service descriptions, program materials, training protocols, written materials, videos, and website content are protected intellectual property.

You may not use Train Smart PR intellectual property without written permission.

18. Third-Party Links

Our website may contain links to third-party websites, platforms, payment processors, social media pages, or external resources.

Train Smart PR is not responsible for the content, privacy practices, terms, accuracy, security, or availability of third-party websites or services. Use of third-party websites is at your own risk.

If you voluntarily provide a testimonial, review, image, or other content, you grant Train Smart PR permission to use that content for business, educational, or marketing purposes unless otherwise agreed in writing.

22. Safety and Conduct

Train Smart PR reserves the right to refuse, suspend, or terminate services for unsafe, inappropriate, threatening, abusive, discriminatory, disruptive, or disrespectful behavior.

Clients must follow facility rules, staff instructions, and safety procedures. Misuse of equipment or failure to follow safety instructions may result in immediate termination of the session or program without refund.

23. Facility Rules

Clients may be required to follow facility-specific rules regarding attire, footwear, hygiene, equipment use, arrival times, personal belongings, guest access, and safety procedures.

Train Smart PR is not responsible for lost, stolen, or damaged personal property.

24. Minors

Minors may participate only with parent or legal guardian consent and when Train Smart PR determines that the selected service is appropriate.

A parent or legal guardian may be required to sign forms, remain present, or provide medical clearance depending on the program and the minor’s age, condition, or service type.

25. Changes to Services and Pricing

Train Smart PR may modify, update, discontinue, or replace services, programs, schedules, pricing, packages, promotions, or website content at any time.

Changes do not affect services already paid for unless required by law, safety, operational needs, or mutual agreement.

26. Force Majeure

Train Smart PR is not responsible for delays, cancellations, interruptions, or inability to provide services due to events outside its reasonable control, including but not limited to natural disasters, power outages, equipment failure, government restrictions, public health emergencies, severe weather, labor disruptions, or other unforeseen events.

27. Governing Law

These Terms and Conditions shall be governed by the applicable laws of Puerto Rico and any applicable federal laws of the United States.

Any dispute related to these Terms, the website, services, or purchases shall be handled in the appropriate jurisdiction unless otherwise required by law.

Train Smart PR may update or modify these Terms and Conditions at any time. The updated version will be posted on our website with a revised effective date.
